Description

The Italian region of Lazio drafted a manifesto of the ‘Fundamental rights in the gig-economy’ and new legislation titled ‘Proposal for a regional law on standards for the protection and security of digital workers’. The law addresses the protection of platform workers' dignity, health, and safety. It also seeks to improve transparency in the digital labour market and combat unsafe work practices and exploitation

The new law was adopted after a public consultation phase and addresses wages of platform workers, transparency of platforms’ operations as well as health, safety and social security aspects of platform work.

The law mentions several rights and obligations, including: * The right to fair and equitable treatment, health, and safety protection (Article 1) * The right to access social protection, training, and fair compensation (Article 1) * The right to a minimum hourly wage and compensation for pre-booking (Article 5) * The obligation for digital platforms to provide information on the risks associated with the work, the terms of the contract, and the compensation (Article 6) * The obligation for digital platforms to adopt measures to prevent accidents and ensure the health and safety of platform workers (Article 3) * The obligation for digital platforms to provide insurance coverage for digital workers against accidents and occupational diseases (Article 4) * The obligation for digital platforms to respect the principles of transparency, fairness, and non-discrimination in the management of digital workers' ratings and reputations (Article 7) * The right to a transparent and fair evaluation of their performance and rating (Article 7) * The right to access the anagrafe and the registro, which are the regional registry of digital workers and the registry of digital platforms, respectively (Article 9) * The obligation for digital platforms to comply with the provisions of the law, including the payment of sanctions in case of non-compliance (Article 8)
