Description

In May 2022, the Spanish Ministry of Labour published a guidebook on the ways algorithms are being used in workplaces for hiring purposes, the determination of schedules, performance evaluation or productivity control. The objective of the publication is to provide an overview of all existing obligations and rights concerning algorithmic management which are encoded into Spanish labour law.

This concerns the obligations of companies to provide information on their usage of algorithms to worker representatives. The guidebook also lays out, which information businesses can rightfully request from the workforce. Furthermore, it explains businesses’ rights and restrictions to using algorithms for the purpose of audit and impact assessments.
