Description
On 4 August 2026 the Ministry of Family, Labour and Social Policy announced that the draft act on the performance of work via digital labour platforms (ustawa o wykonywaniu pracy za pośrednictwem cyfrowych platform pracy), transposing Directive (EU) 2024/2831, had been entered in the government's legislative agenda and would go to public consultation, inter-ministerial coordination and review.
The draft, dated 6 August 2026, was published on the website of the Government Legislation Centre (RCL).
The main elements are:
- a rebuttable presumption of an employment relationship: in a dispute, the worker need only show that they work under the direction and control of the platform or its intermediary, and the platform or intermediary must prove that the person is not an employee within the meaning of the Labour Code. The presumption applies in court proceedings and in administrative proceedings before the State Labour Inspection (PIP);
- greater control over algorithmic management, including limits on fully automated decisions without human involvement, for example when a platform terminates a contract;
- stronger protection of platform workers’ personal data, with penalties for platforms that breach it;
- an obligation on platforms to notify the PIP that a person works through the platform and of any cooperation with intermediaries, with sanctions for non-compliance.
