Description
The decree No. 2024-388 of 25 April 2024 establishes the official system and legal basis for specific digital platforms to collect and transmit statistical data about their activities and the self-employed workers, specifically in the sectors of chauffeur-driven transport and goods delivery.
The decree requires digital labour platforms to collect and transmit statistical data related to their operations and the activities of self-employed workers to the Employment Platforms Social Relations Authority (ARPE).
It authorises the relevant platforms to process personal and activity data for this purpose and authorises ARPE to receive and analyse this data to produce statistical reports, aimed at supporting social dialogue in these sectors. It explicitly states that the detailed list of required statistics will be specified in a separate ministerial Order Arrêté (Order) of 25 April 2024.
This Decree provides the core legal authorisation and obligation for platforms to engage in this data reporting. Platforms must set up systems to comply. They are formally designated as data controllers for this process and must inform workers about the data processing according to data protection laws (like GDPR). They must submit data annually (by 1st April) in a machine-readable format and include aggregated indicators, averages, and distributions.
