Description
The Department of Labour Relations of the Ministry of Labour and Social Insurance has published two draft bills to transpose Directive (EU) 2024/2831 on improving working conditions in platform work: the Social Insurance (Amendment) Law of 2026 and the Regulation of the Working Conditions of Persons Employed on Platforms Law of 2026. The drafts were open for comments on the government's e-Consultation platform until 24 September 2026.
The definition of a digital labour platform reproduces the four cumulative criteria in Article 2 of the Directive.
There is no national list of criteria for the presumption of employment. Instead, the presumption applies where facts indicate direction and control, and the bill refers to CJEU case law to determine employment status.
The presumption is placed in social insurance law. It can be triggered by the worker or their representative through a request to the Director of Social Insurance Services, or by an investigation the Director opens on their own initiative.
The platform must prove that the relationship is not one of employment. Procedures for rebuttal, early identification of non-compliant platforms, inspections and enforcement are left to guidance issued by the Director. The working conditions bill covers platforms organising work in the EU regardless of where they are established, restricts personal data processing by automated monitoring and decision-making systems, and sets transparency requirements for these systems. Breaches are criminal offences, punishable by up to six months' imprisonment, a fine of up to €5,500, or both.
