Description

On 20 November 2023, the Court of Palermo has ruled that the excellence based selection system used by Foodinho is discriminatory and violates the principle of equal treatment.

To calculate the excellence score ascribed to riders, aspects such as the number of deliveries made and the amount of high demand hours worked were considered. As a result of the excellence scores, certain riders were able to choose slots in which they would like to work over other riders with lower excellence scores.

The court ruled that this system ignores the individuality of workers in competition with one another deliberately, and as a result, workers who are disadvantaged by personal circumstances or a disability are further being discriminated against and put in an unfavourable position. Foodinho must now develop a plan in consultation with trade unions to eliminate the discriminatory effects, and pay a compensation of 40,000 Euros to the unions.
