Description

In July  2018, a collective agreement was concluded in the Italian logistics sector which now for the first time includes food delivery riders in its contractual qualifications. The agreement was signed by the unions Confetra, Anita, Conftrasporo, Can-Fita, Transport Confartigianato, Sna-Casartigiani, and by employer organisations such as Claai and Filt Cgil.

The agreement covers several employment aspects:

  • Wages - remuneration is differentiated according to the type of vehicle used for delivery (i.e. bike or motorbike) and the length of employment of each worker.  An automatic wage increase was implemented for workers who work for 6 months or more and for motorcyclists who work for 9 months or more. Wage levels are set to €1,447.68 for the entry level jobs, €1,526.63 for workers who have been in employment for at least 6 months and €1,566.13 for motorcyclists after 9 months. These wage levels correspond to the lowest levels set in the sectoral collective agreement.
  • Working time - work can be organised both on a full time and a part time basis. The weekly working time is set to 39 hours and can be distributed over a maximum of 6 days. The agreement also sets a minimum of 2 working hours per day and 10 hours per week for part-time workers. The agreement foresees the possibility for companies and workers to agree upon clauses enabling variation in the daily amount of working hours and of their distribution during the week (the so called ‘clausole elastiche’). The agreement must be concluded in writing. Such variations should be communicated by the company to the workers with a notice of at least 11 hours.
  • Health and safety - the agreement sets that personal protective equipment, such as helmets and reflective harnesses, are expected to be provided free of charge by companies according to the specific requirements of the performed activity.
  • Third party insurance - the agreement sets that companies should insure cyclists against damages to third parties.
  • Territorial and company-level collective bargaining - to define the characteristics of the employment relationship in a more specific way, the signatory parties commit themselves to meet, upon request by one of the parties, for negotiating specific territorial or company-level agreements. These agreements might include, among others, issues connected to the functioning of the platforms and their algorithms.

Scale of the initiative The agreement led to the signing of several company level collective bargaining agreements. In May 2019, the first agreement in Italy foreseeing the status of employee for food-delivery riders was signed in Laconsegna, a company located in the province of Florence. Furthermore, platform Mymenu which is located in Bologna decided to hire its riders as employees and to apply the terms and conditions foreseen by the sectoral collective agreement of the logistics industry.

In 2021 Just Eat decided to hire its workers as subordinate employees as part of the change towards a new business model which will lead to the hiring of about 4,000 riders throughout Italy. After a negotiation with the signatory trade unions (FILT-CGIL, FIT-CISL and UIL Trasporti) and several grassroots organisations (the so-called Riders Unions), in April 2021 a company labour agreement was reached which places these workers under the premises of the sectoral collective agreement of the logistics industry. According to a company’s press statement, the company level agreement aims at making the national collective labour agreement for the logistics, freight transport, and shipping sector compatible with the food delivery business and the needs of the company.
